General Terms and Conditions - Decades Collective B.V (download)

Article 1. Definitions

In these terms conditions, the following definitions apply:
● General Terms and Conditions: the General Terms and Conditions of Decades
Collective
● Decades Collective: Decades Collective B.V. (Chamber of Commerce number:
95430636), registered at Cantaloupenburg 55A, 2514KK, Den Haag, reachable via
hello@decadescollective.com
● Agreement: any agreement between Decades Collective and a Participant
● Session: A single event in which an Teacher shares knowledge or teaches skills to
the Participants. For example, a masterclass, class, lesson, training, workshop, or
presentation
● Course: a series of multiple Sessions, which automatically ends after the final
Session. For example, a Crash Course or Lab
● Teacher: a natural or legal person appointed or hired by Decades Collective to deliver
a Session or Course to Participants
● Participant: the natural or legal person who participates in a Session or Course of
Decades Collective
● Course Fee: the total price for a Session or Course, including VAT
● Open Enrollment: a Session or Course organized by Decades Collective for which
individual Participants can register

Article 2. Applicability of Terms

2.1 These General Terms and Conditions apply to all offers, registrations, and
agreements relating to Sessions, Courses organized by Decades Collective, and related
services.
2.2 By registering for a Session or Course, the Participant agrees to these General
Terms and Conditions.
2.3 Decades Collective reserves the right to modify these general terms and conditions,
with the revised conditions taking effect upon publication on the website or after written
notification to the Participant.

Article 3. Registration, Prices, and Payment

3.1 Registration for a Session or Course must be completed via the designated
registration form.
3.2 All prices listed within the course offerings include 21% VAT.
3.3 Published prices are always subject to change.
3.4 Upon registration, the Participant is liable for the full Course Fee.
3.5 To guarantee the Participant’s registration in the desired course, on the chosen days
and times, the full Course Fee must be paid before the start of the Session or the first
Session of the Course, unless otherwise agreed, such as through a payment arrangement
with a 'buy now, pay later' provider. If the Participant opts to pay via Klarna, he/she agrees to
Klarna's payment terms. For more information on Klarna's terms, we refer to Klarna’s
general terms and conditions.
3.6 Decades Collective reserves the right to determine if it is possible to join an already
started Course. In the case of mid-course enrollment, the full Course Fee must be paid,
unless otherwise agreed.
3.7 The payment of the Course Fee is only valid for the specified course.
3.8 Registration is personal. Registrations cannot be transferred to another person.
3.9 In the event of non-payment or late payment of the Course Fee before the start of the
Session or Course, Decades Collective reserves the right to cancel the registration or
suspend access to the Session or Course until the payment has been made in full. The
Course Fee remains due in such cases. Once the outstanding payment is settled, the Participant can resume participation in future Sessions or Courses, provided there are still
available places.

Article 4. Cooling-off Period and Right of Withdrawal

4.1 The Participant has the right to withdraw from registration within 14 days of signing
up without giving reasons and without incurring additional costs.
4.2 The right of withdrawal expires once the Session or Course has begun, regardless of
whether the Participant has actually participated.
4.3 To exercise the right of withdrawal, the Participant must contact Decades Collective
in writing at hello@decadescollective.com. The date on which Decades Collective receives
this notification is decisive.
4.4 If the Participant exercises the right of withdrawal within the cooling-off period and
the Session or Course has not yet begun, Decades Collective will refund the paid Course
Fee within 14 days of receiving the withdrawal.

Article 5. Cancellation by the Participant Outside the Cooling-off Period

5.1 After the 14-day cooling-off period has expired, as described in Article 4, the
following cancellation conditions apply:
a) Up to 14 days before the start of the Session or Course, the Participant can cancel
free of charge, and the full Course Fee will be refunded;
b) If the cancellation occurs within 14 days before the start of the Session or Course,
Decades Collective is entitled to a reasonable compensation equal to the full Course
Fee. No refund will be issued in this case.
5.2 Cancellation by the Participant must be done in writing via
hello@decadescollective.com. The date of receipt of the cancellation is decisive.
5.3 If the Participant misses one or more Sessions, either partially or completely, no
refund of the Course Fee will be provided.

Article 6. Changes and Cancellations by Decades Collective

6.1 Decades Collective reserves the right to make changes regarding the location,
schedule, and/or teachers during a course period due to unforeseen circumstances.
Participants will be informed of such changes as soon as possible. Cancellations for this
reason are not permitted.
6.2 A course or session can only commence if a sufficient number of participants are
enrolled. If the minimum number of participants is not reached, Decades Collective reserves
the right to cancel the course or session before it starts. In the event of cancellation by
Decades Collective prior to the start of the course, the full course fee will be refunded.
6.3 In special cases, for substantive quality reasons, Decades Collective may terminate
the agreement with the participant prematurely. For example, this may occur due to
participants canceling mid-course, resulting in too few participants to continue the lessons,
or due to the prolonged illness of a teacher. In the event of cancellation during the course,
the refund of the course fee will be determined based on the number of lessons that have
already taken place.
6.4 If Decades Collective is not able to conduct a part of the Course due to
circumstances, including government measures, the Course Fee will be refunded pro rata
based on the number of lessons that have already taken place.
6.5 In the event of illness or absence of a teacher, Decades Collective will try to arrange
a replacement. If this is not possible, the lesson will be canceled via email or phone.
Decades Collective will attempt to make up for the canceled lesson at the end of the course;
this session may take place on a different day and time. If it is not possible to schedule the
session, the participant has the right to request a refund for the lesson that did not occur.

Article 7. Liability

7.1 Participation in Sessions organized by Decades Collective is at the participants' own
risk.

7.2 Decades Collective is not liable for any injuries, or for loss, damage, or theft of
property, or for any other accidents occurring during sessions or courses, or at the location.
7.3 Decades Collective is not liable for any damage incurred by participants due to the
inability to fully conduct Sessions or Courses.
7.4 Participants are responsible for handling the property and facilities of the lesson
location with care. Decades Collective reserves the right to charge the responsible
participant for costs arising from damage to the property of the location as a result of
negligence, intentional acts, or inappropriate behavior by a participant.

Article 8. Conduct and Responsibilities of Participants

8.1 Decades Collective has house rules that apply to all Participants in Sessions and
Courses. These house rules can be found on https://decadescollective.com/terms/ or can be
provided upon request via email. By agreeing to these general terms and conditions, the
participant also declares to agree to the applicable house rules.
8.2 Decades Collective reserves the right to modify the house rules as deemed
necessary. Participants will be informed of changes via email or through an update on the
website. The amended house rules will take effect from the moment of announcement,
unless otherwise stated.
8.3 If the behavior of a participant leads to a violation of the house rules or disrupts the
order during a session or course, Decades Collective, including appointed teachers,
reserves the right to deny further participation of the Participant. In this case, the Participant
is not entitled to a refund of the Course Fee.

Article 9. Confidentiality and Personal Data

9.1 Decades Collective, its employees, and third parties engaged by Decades Collective
will treat the information and personal data provided by participants confidentially, in
accordance with the General Data Protection Regulation (GDPR), unless otherwise agreed
or required by law.
9.2 During sessions, courses, and events, photos and video recordings may be made,
which may be used by Decades Collective for promotional purposes for our website,
channels, and other media. By registering for a Session or Course, the participant
automatically agrees to the use of images in which they appear. The Participant may
withdraw their consent for the use of images by notifying hello@decadescollective.com.

Article 10. Intellectual Property and Recording Policy

10.1 The instructional materials offered during the lessons are the intellectual property of
Decades Collective or the appointed teacher and may not be distributed or copied without
prior written permission.
10.2 Participants are not permitted to use recording devices (film or audio) during the
lessons unless Decades Collective has granted permission for this.
10.3 The documents, brochures, handouts, presentations, exercises, offers, information
on the website or social media channels, newsletters, emails, templates, techniques, and
other materials, including images, videos, or other forms of media, developed by Decades
Collective, as well as the software used by Decades Collective, are the property of Decades
Collective or the parties from whom Decades Collective has obtained licenses, unless
otherwise indicated.
10.4 It is not permitted to remove or alter any information regarding the rights to these
materials.

Article 11. Complaints and Disputes

11.1 Decades Collective strives to ensure the highest quality in its services. If a Participant
has a complaint regarding the services of Decades Collective, this complaint can be
submitted via email (hello@decadescollective.com).
11.2 If a complaint is not submitted in writing to Decades Collective within a reasonable
time after the complaint arises, the Participant is deemed to have accepted the services provided and to have waived all rights and claims they may have under the agreement with
Decades Collective or under the law. The submission of a complaint does not affect the
obligation to make payments.
11.3 When the parties cannot reach a suitable resolution among themselves, the
Participant or Decades Collective can turn to De Geschillencommissie
(https://www.degeschillencommissie.nl/). A dispute will only be accepted if the complaint has
first been submitted to Decades Collective and has not resulted in an acceptable resolution.
The ruling of De Geschillencommissie is a binding recommendation and will always be
treated confidentially.

Article 12. Applicable Law and Forum Choice

12.1 All Agreements entered into with Decades Collective are subject exclusively to Dutch
law.
12.2 Disputes that have not been resolved by De Geschillencommissie will be settled by
the competent court. Consumers may also submit these disputes to the court in their place
of residence.

Article 13. Force Majeure

13.1 Decades Collective is not obliged to fulfill any obligation if it is hindered by a
circumstance that is not attributable to fault, nor comes under the law, a legal act, or
prevailing views.
13.2 For the purposes of these General Terms and Conditions, force majeure is
understood to include, in addition to what is understood in law and case law, all external
causes, whether foreseeable or not, over which Decades Collective has no control.

Article 14. Modification of the General Terms and Conditions

14.1 These General Terms and Conditions may be amended by Decades Collective.
Notification will take place through a personal announcement, provision before or during the
conclusion of the agreement, or a general announcement on the Decades Collective
website.
